These Terms of Service (“Terms”) govern your access to and use of Kapaas (the “Service”), operated by [Legal Entity Name] (“Kapaas”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. If you are agreeing on behalf of an organisation, you represent that you are authorised to bind that organisation.

1. Accounts & workspaces

You must provide accurate information and keep your credentials secure. Each workspace (organisation) may add members up to the seats included in its plan. You are responsible for activity under your account and workspace.

2. Plans, credits & billing

Paid plans are billed in advance on a recurring basis and include a monthly allotment of credits. Credits are consumed by AI generations and related operations; unused plan credits refresh each billing cycle and do not roll over unless stated. You may purchase additional credits. Fees are non-refundable except as required by law or as stated in our refund policy. Taxes are your responsibility where applicable.

3. Cancellation

You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then. We may suspend or terminate accounts for breach of these Terms or non-payment.

4. Your content & ownership

You retain ownership of the mood boards, images, and other materials you upload (“Your Content”) and of the designs generated for you. You grant us a licence to host and process Your Content solely to provide the Service. You are responsible for ensuring you have the rights to any material you upload, and for your use of generated outputs.

5. Acceptable use

Do not use the Service to infringe others’ rights, upload unlawful content, attempt to disrupt or reverse-engineer the Service, or exceed rate/usage limits by automated means. AI outputs may be imperfect; you are responsible for reviewing them before production use.

6. Third-party AI services

The Service uses third-party AI providers to generate images, text, and video. Your use is also subject to those providers’ acceptable-use policies.

7. Warranties & liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, our aggregate liability is limited to the amounts you paid in the three months preceding the claim, and we are not liable for indirect or consequential damages.
